The article provides a comprehensive analysis of the significance of the final stage of pre-trial investigation in criminal proceedings and its role in safeguarding individual rights as well as ensuring the effective protection of public interests. Special attention is devoted to the procedural guarantee of granting the defence and the victim access to case materials, which is essential for the effective exercise of the right to defence and corresponds to the standards developed by the European Court of Human Rights regarding the individual's right to sufficient information for meaningful use of remedies. The study emphasizes the importance of timely decision-making at this stage, since delays lead to legal uncertainty and violate the principle of the rule of law. The article analyzes the public-law dimension of the final stage, including the formation of a well-founded accusation, optimization of state resources, prevention of the return of indictments, and enhancement of the overall efficiency of criminal justice. It is argued that the final stage of pre-trial investigation has independent substantive value and strategic importance, as it ensures a balance between private and public interests and directly affects the effectiveness and predictability of criminal proceedings. The author concludes that legislative refinement is necessary, particularly regarding access to materials in cases of termination of criminal proceedings, as this is essential for guaranteeing the right to a fair trial and ensuring compliance with international human rights standards.
