Abstract
The article examines the investigating judge's ruling as a key legal basis for restricting human rights at the pre-trial investigation stage, with particular emphasis on the principle of proportionality. This stage of criminal proceedings involves the most intensive interference by the state with individual rights; therefore, the clarity, predictability, and justification of judicial decisions become crucial safeguards against arbitrariness. Based on the Criminal Procedure Code of Ukraine, case law of the Constitutional Court, and the jurisprudence of the European Court of Human Rights, the author demonstrates that proportionality serves as a universal criterion for assessing the necessity, scope, and legitimacy of restrictions imposed on individuals. Special attention is paid to the requirement of the «quality of law,» foreseeability of procedural norms, and the existence of effective judicial oversight mechanisms. It is emphasized that rulings of investigating judges must meet the standards of legality, reasoning, motivation, and comprehensibility, as these ensure genuine protection of individual rights. Examples from national case law illustrate problems arising from vague, excessively broad, or unlawful restrictions that contradict proportionality. The article also highlights the importance of effective appellate review, as affirmed by the Supreme Court, for maintaining a fair balance between public interests and individual rights. The author concludes that the quality of procedural decisions by investigating judges is a decisive factor in ensuring proportionate interference with human rights and constitutes an essential safeguard of fairness in pre-trial proceedings.
