The article examines the correlation between written cassation proceedings in the criminal justice system of Ukraine and the individual's right to a fair trial guaranteed by Article 6 of the European Convention on Human Rights (ECHR). The author presents doctrinal approaches regarding the feasibility and expediency of expanding the institution of written proceedings in the cassation court. A comparative (comparativist) study of the criminal procedural institution of written cassation proceedings in different countries is carried out. International legal instruments and the case law of the European Court of Human Rights (ECtHR) are analyzed in terms of the potential risks of written cassation proceedings for the effective implementation of the right to a fair trial. Based on the conducted analysis, it is concluded that the limitation of the right to be present and to be heard during cassation proceedings conducted in written form (provided that this institution is properly regulated by law) is compatible with Article 6 of the ECHR. The author develops a normative model of written cassation proceedings and proposes that, upon opening cassation proceedings, the court may schedule a written or oral hearing. A written hearing should be appointed if the materials available in the case are sufficient for the consideration of the cassation appeal. The cassation court should hold an oral hearing if it is necessary to obtain explanations or documents from the parties and other participants, or if, in the court's opinion, the decision resulting from the cassation review will have significant importance for the interpretation of legal norms, the cassation appeal is filed on grounds that worsen the position of the convicted, acquitted, or a person whose case has been closed, or in other cases depending on the circumstances of the criminal case.
