This article examines the constitutional order as the direct object of the criminal offense under Art. 109 of the СC of Ukraine. It emphasises that the issue of ensuring and upholding the constitutional order in today’s world has become a priority not only for criminal law experts but also for constitutional scientists. The concept of the constitutional order occupies a central place in modern constitutional theory, as it defines the fundamental principles of the organisation of state and social life. This research aims to determine which meaning of the «constitutional order» – as identified in constitutional law doctrine – should be employed when characterising the object of the criminal offence under Art. 109 of the Ukrainian СC. In the context of Ukrainian constitutional law research, the concept of «constitutional order» has been identified as multifaceted: (1) a system of fundamental political and legal principles; (2) a form of state organisation; (3) a state of social relations characterising a constitutional state. It has been demonstrated that all three of these distinct aspects are significant for characterising the social value of social relations as the object of a criminal offence under Art. 109 of the СC of Ukraine. The third aspect of the concept of «constitutional order» is linked to the study of the state of legal relations and therefore cannot be formally defined. It has been concluded that the principles of the constitutional order are enshrined in the Constitution of Ukraine at three levels: first, in Art.1; second, in the other articles of Section I, «General Principles»; and third, in the other sections. It is important to note that the subjects of social relations protected by Art. 109 of the Ukrainian СC are the state and citizens and civil society. The social relationship between these subjects takes a static form, manifested in the state’s position, which consists in maintaining a state of affairs in which it is subject to the law.
