The Article continues the presentation of the study's results on the criminality of conducting clinical trials of medicinal products in Ukraine. It analyzes judicial practice and prospects for the development of criminal legislation in this area. The analysis of judicial practice in criminal law regulation in the field of conducting clinical trials of medicinal products confirmed the conclusion reached in the previous Article about the negative impact on law enforcement practice of the shortcomings of the criminal law that take place under Article. Article 141 of the Criminal Code of Ukraine «Violation of Patient Rights» and Article 3212 of the Criminal Code of Ukraine «Violation of the Established Procedure for Preclinical Studies, Clinical Trials and State Registration of Medicinal Products». Under these articles, since 2013, no convictions have been issued, but the provisions of Art. are incorrectly applied. Article 141 of the Criminal Code of Ukraine, at the stage of registration of criminal offenses, as well as a ratio of 39 to 1 regarding registered criminal offenses under Article 3212 of the Criminal Code of Ukraine, and those that were sent to court. The hypothesis put forward at the initial stages of the study regarding the need to improve Ukraine's criminal legislation on the punishability of conducting clinical trials of medicinal products was confirmed. Analysis of the draft Law on Amendments to the Criminal Code of Ukraine regarding the improvement of liability for violation of the established procedure for preclinical studies, clinical trials, and admission to the market of medicinal products. Registration No. 11181– 1 dated 03.05.2024 showed that the provisions set out therein are logical, systematic, and will have a positive impact on the quality and effectiveness of legal regulation in this area. The construction of a system of criminal law norms in this area, depending on the nature of the harm caused, proposed in the draft law, was recognized as justified. The specified system should include a norm on the violation of the rights of an individual (subject), intentional violations during the release of medicinal products to the market (state registration), as well as intentional significant violations of conducting clinical trials of medicinal products.
