(Право, 2025)Lapkin A.The article examines the problems of establishing disability as a result of war faced by the civilian population of Ukraine. The relevance of this topic is due to a significant increase in the number of persons affected by hostilities in Ukraine, including persons with disabilities. The purpose of the article is to assess the feasibility of maintaining the link between the procedure for establishing disability as a result of war and criminal proceedings and to develop practically oriented proposals aimed at improving this procedure. It is established that initiating the establishment of the fact of injury caused by explosive devices requires submission of documents which can be obtained only within criminal proceedings. At the same time, the submission of these documents by an injured person has a number of organizational and procedural obstacles, creating additional difficulties, challenges and threats for him/her. It is substantiated that the existing procedure for establishing the link between disability and injuries or other health damage provided for in the Procedure for establishing the link between disability and injuries or other health damage approved by the Resolution of the Cabinet of Ministers of Ukraine No. 306 of April 25, 2018, violates the international principles of ensuring the rights of persons with disabilities, is discriminatory and restricts a person’s access to obtaining the appropriate legal status of a person with a disability resulting from war. The author analyzes two possible options for improving this procedure: (1) by amending the CPC of Ukraine to entitle state authorities to receive medical expert opinions and extracts from the URPTI in cases of establishing the status of a person with a disability as a result of war, and (2) by amending the Procedure and other legislative acts not related to the CPC of Ukraine. The author concludes that it is advisable to choose the second of these approaches, which involves separation of the procedure for establishing the connection between disability and injuries or other health damage from criminal proceedings.Item type:Item, Позитивні відносини між персоналом установ виконання покарань та засудженими як основа динамічної безпеки ;Гавриленко Н. А. (Право, 2025)Gavrylenko N.The article provides a detailed exploration of the role of positive relationships between prison staff and inmates as a fundamental component of dynamic security within the penitentiary system. The author emphasizes that dynamic security is not achieved solely through physical infrastructure or formal procedures, but rather through constructive interaction, mutual respect, and effective communication between staff and incarcerated individuals. This approach is grounded in international legal frameworks, such as the European Prison Rules and the United Nations Standard Minimum Rules for the Treatment of Prisoners, as well as Ukrainian national legislation. The article highlights the importance of staff professionalism, ethical conduct, and the development of individualized support systems that foster rehabilitation, reduce tension, and lower recidivism rates. The study also addresses the lack of normative clarity in Ukrainian legislation regarding the definition and implementation of positive relationships in correctional settings, suggesting the need for legislative reforms. The author argues that successful resocialization depends not only on strict compliance with institutional rules but also on the humanization of punishment, the ability to establish trust, and the provision of psychological and social support. These elements are essential for transforming the penitentiary environment into one that supports reintegration rather than isolation. The findings contribute to current discussions on the reform of the criminal justice system in Ukraine and its alignment with European standards.Item type:Item, Завершення досудового розслідування в системі кримінального процесу ;Клепка О. Г. (Право, 2025)Klepka O.The article deals with the issues of the place of completion of the pre-trial investigation in the criminal procedure system. The author proves the need for scientific research into the issues related to the completion of the pre-trial investigation, namely, clarification of its legal nature, place in the criminal procedure system, and characteristic features with a view to assessing the criminal procedure legislation regulating the procedure for completion of the pre-trial investigation in terms of qualitative characteristics; and also to identifying the problematic issues of law application practice and possible ways to overcome them. The author reviews the scientific literature on the periodisation of pre-trial investigation according to its stages. The author provides arguments in favour of the possibility of distinguishing the stage of completion in the pre-trial investigation which ends in the form of closure of criminal proceedings. Based on the review of the ECHR case-law, the author proves that national legislation needs to be improved in terms of securing the victim’s right of access to the pre-trial investigation materials in case of its closure. It is proposed to provide for a provision, similar to Article 290 of the CPC of Ukraine, which would provide for the possibility of a victim’s access to the criminal proceedings before the decision to close them is made. Based on the research conducted, the author concludes that the completion of the pre-trial investigation is a stage of the same name, which begins with the decision to complete the pretrial investigation and ends with the entry of information into the URPTI in accordance with the form of completion of the pre-trial investigation provided for in Part 2 of Article 283 of the CPC of Ukraine. The characteristic features of the stage of completion of the pre-trial investigation are: systematic; regulated by the norms of the current criminal procedural legislation; discretionary nature of the beginning; differentiation of the procedural form in accordance with the form of completion provided for in Article 283 of the CPC of Ukraine.
