The article analyzes the issues surrounding the determination of the unlawfulness of acts committed by public officials who privatize state-owned housing stock for their own benefit or for the benefit of others, while abusing their official positions. Examples are provided of gaps and shortcomings in legislative acts that affect the determination of the unlawfulness of an act as a mandatory element of a criminal offense when public officials privatize state housing stock for their own benefit or that of third parties. International experience in managing state property is taken into account, demonstrating a shift toward a strategy of preserving the housing stock (particularly service housing) in state ownership without the right to privatize it under any circumstances, as well as practices of providing citizens with affordable social housing for rent based on their income level. The methods by which public officials carry out the privatization of the state housing stock are identified; although these methods exhibit the elements of a criminal corruption offense, they cannot be deemed unlawful due to gaps in the legislation. In the context of the issue under study, the most common methods of carrying out such actions are identified and analyzed in detail: (a) the use of close relatives as nominal owners, where a person who has already fully exercised their right to privatize state-owned housing enlists relatives (who have not yet exercised this right) to privatize the property in their favor and subsequently register ownership rights fictitiously; (b) repeated privatization with a partial additional payment, where a person who previously exercised only part of their right to free privatization repeats the procedure in their own favor, appropriating the property through the mechanism of an additional payment. It is proposed to amend the regulatory acts governing the privatization of state housing stock to resolve the issues that arise in law enforcement when recognizing the actions of public officials as unlawful during the privatization of state housing stock.
