Currently, most of the so-called «venereal diseases» are well-researched by specialists, effective treatment and prevention schemes have been developed. Most EU countries have long since abandoned the preservation of a special norm on criminal liability for the spread of such diseases or for intentional infection with them. EU countries consider such actions as causing bodily harm to a person. Instead, the Criminal Code (hereafter – CC) of Ukraine still contains Article 133 (infecting another person with a venereal disease). However, in view of the European integration processes, it is advisable to reconsider the issue of preserving the specified norm in the Ukrainian criminal law. Therefore, the purpose of the study is to establish the feasibility or inexpediency of preserving the Article 133 of the CC of Ukraine by analysing the history of the emergence of the so-called «venereal diseases», the reasons for the criminalization of their spread, studying the latest medical achievements in their treatment and prevention, as well as studying the judicial practice of prosecuting persons for contracting a venereal disease. As a result, was established that: 1) the term «venereal disease» is an anachronism; 2) most diseases that are mainly sexually transmitted are now amenable to quick and effective treatment or modern drugs can stop the development of the disease; 3) Ukrainian regulatory legislation does not know what a «venereal disease» is, so bringing to criminal liability those guilty of their spread is impossible. The existing judicial practice is outdated and scanty. Based on the above, it is proposed to abandon discrimination and stigmatization of sick people by excluding the norm provided for in the Article 133 from the CC of Ukraine. It is recommended that the state’s efforts focus on successfully preventing the spread of diseases, their early diagnosis, and rapid treatment. This will harmonize national legislation with international and European standards, thereby increasing the effectiveness of the fight against infections and ensuring an adequate level of public health.
