Єдність та диференціація професійної етики слідчих різних органів досудового розслідування

Abstract

У науковій статті досліджується питання єдності та диференціації професійної етики слідчого. Актуальність обраної теми зумовлена важливим значенням дотримання високих стандартів професійної поведінки слідчими різних органів досудового розслідування. Метою наукової статті є визначення співвідношення єдності та диференціації професійної етики слідчих різних органів досудового розслідування, а також обґрунтування оптимальної моделі регламентації професійної етики слідчого. Аргументовано, що єдність професійної етики слідчих визначається єдиним процесуальним статусом слідчого та засадами і завданнями кримінального провадження, що є визначальними для його діяльності Крім того, як на осіб, що виконують функції держави, на слідчих поширюються єдині правила етичної поведінки, визначені Законом України «Про запобігання корупції». Доведено, що основу для диференціації професійної етики слідчого створює їх відомча відокремленість. У межах кожного правоохоронного органу, де є слідчі підрозділи (підрозділи детективів), затверджено окремі правила (кодекси) етичної поведінки. Значною мірою їх зміст є тотожним, водночас наявні й певні відмінності, зумовлені специфікою завдань того чи іншого правоохоронного органу. Проаналізовано відомчі правила (кодекси) етики правоохоронних органів. Виявлено проблему, яка полягає в тому, що такі документи не приділяють належної уваги регламентації особливостей слідчої діяльності. Запропоновано створення єдиного кодексу професійної етики слідчого, який би поширювався на всіх слідчих, дізнавачів та детективів, незалежно від їх відомчої належності. Окреслено можливу структуру такого кодексу, а саме: 1) загальні положення щодо професійної етики слідчого; 2) правила взаємовідносин слідчого із прокурором, слідчим суддею (судом), учасниками кримінального провадження: потерпілим, підозрюваним, захисником та ін.; 3) етичні основи проведення слідчих (розшукових) дій, збирання та оцінки доказів; 4) етичні обмеження щодо застосування процесуального примусу тощо.

This academic article examines the issue of unity and differentiation in the professional ethics of investigators. The relevance of the chosen topic stems from the importance of investigators from various pre-trial investigation bodies adhering to high standards of professional conduct. The aim of this academic article is to determine the relationship between the unity and differentiation of the professional ethics of investigators from various pre-trial investigation bodies, as well as to justify an optimal model for regulating the professional ethics of investigators. It is argued that the unity of professional ethics among investigators is determined by the investigator’s uniform procedural status and the principles and objectives of criminal proceedings, which are decisive for the investigator’s activities. Furthermore, as persons performing state functions, investigators are subject to the uniform rules of ethical conduct set out in the Law of Ukraine ’On the Prevention of Corruption’. It has been demonstrated that the basis for differentiating the professional ethics of investigators lies in their institutional independence. Within each law enforcement agency that has investigative units (detective units), separate codes of ethical conduct have been established. To a large extent, their content is identical, yet there are certain differences stemming from the specific nature of the tasks of a particular law enforcement agency. The departmental rules (codes) of ethics of law enforcement agencies have been analysed. A problem has been identified, namely that such documents do not pay sufficient attention to regulating the specific features of investigative work. It is proposed that a single code of professional ethics for investigators be created, which would apply to all investigators, inquiry officers and detectives, regardless of their departmental affiliation. The possible structure of such a code is outlined, namely: 1) general provisions regarding the professional ethics of investigators; 2) rules governing the investigator’s relations with the prosecutor, the investigating judge (court), and participants in criminal proceedings: the victim, the suspect, the defence counsel, etc.; 3) ethical principles for conducting investigative (search) activities, and the collection and assessment of evidence; 4) ethical restrictions on the use of procedural coercion, etc.
