Використання штучного інтелекту під час розроблення проблем дотримання прав людини при виконанні покарань і поводженні із засудженими в Україні

Abstract

У статті автор актуалізує проблеми процесів трансформації комунікацій і проникнення цифрових технологій, у тому числі систем штучного інтелекту, в усі сфери дослідницької, організаційно-методичної, просвітньої, педагогічної та інших видів діяльності, широкого наукового дискурсу безпечного використання систем штучного інтелекту для забезпечення прав людини при виконанні покарань і поводженні із засудженими. Акцентовано увагу на реалізації завдань Концепції розвитку штучного інтелекту в Україні у межах фундаментального дослідження на тему «Дотримання прав людини при виконанні покарань і поводженні із засудженими в Україні». Автором визначені такі аспекти, як: профілактика і попередження порушень чинного законодавства у дослідницькій, освітній, правопросвітницькій, консультативній роботі щодо дотримання академічної доброчесності; цілеспрямовані організаційно-правові та інституційні заходи для імплементації ратифікованих міжнародних нормативно-правових актів, документів концептуального змісту, етичних кодексів; визначення відповідних прав і обов’язків працівників та гарантій їх дотримання чинним національним законодавством щодо кібербезпеки; доцільна практика соціально-виховної роботи, реалізації програм диференційованого виховного впливу, корекційних і реабілітаційних програм, загальної і професійної освіти з метою соціальної адаптації; розумне й обґрунтоване використання систем емпатичного штучного інтелекту в роботі центрів пробації, психологічних служб у структурах Державної кримінально-виконавчої служби України, соціального патронажу осіб, які відбувають чи відбули покарання у виді обмеження або позбавлення волі на певний строк. Перспективним аспектом виділено використання інструментарію систем штучного інтелекту для патронажу і абілітації осіб, які відбувають чи відбули покарання у виді обмеження або позбавлення волі на певний строк, у випадках інвалідності таких осіб чи наявності обмежень повсякденного функціонування.

In the article, the author updates the problems of the processes of transformation of communications and the penetration of digital technologies, including artificial intelligence systems, into all areas of research, organizational and methodological, educational, pedagogical and other types of activities, a broad scientific discourse on the safe use of artificial intelligence systems to ensure human rights at execution of sentences and treatment of prisoners. Attention is focused on the implementation of the tasks of the Concept of the development of artificial intelligence in Ukraine within the framework of fundamental research on «Observance of Human Rights in the Execution of Sentences and Treatment of Prisoners in Ukraine». The author identified the following aspects: prevention and prevention of violations of current legislation in research, educational, legal and educational, advisory work regarding the observance of academic integrity; targeted organizational and legal and institutional measures for the implementation of ratified international legal acts, documents of conceptual content, ethical codes; determination of the relevant rights and responsibilities of employees and guarantees of their compliance by the current national legislation regarding cyber security; expedient practice of social and educational work, implementation of programs of differentiated educational influence, correctional and rehabilitation programs, general and professional education for the purpose of social adaptation; reasonable and justified use of empathetic artificial intelligence systems in the work of probation centers, psychological services in the structures of the State Criminal Enforcement Service of Ukraine, social patronage of persons who are serving or have served punishment in the form of restriction of liberty or deprivation of liberty for a certain period. A promising aspect is the use of artificial intelligence tools for patronage and habilitation of persons who are serving or have served a sentence of restriction of liberty or imprisonment for a certain period, in cases of disability of such persons or restrictions on their daily functioning.
