The article describes the problems of social conditionality of criminal liability for obstructing the lawful activities of the Armed Forces of Ukraine and other military formations (a crime provided for in Article 1141 of the Criminal Code of Ukraine). The explanatory note to the draft law on the basis of which the law of April 8, 2014, included Article 1141 in the Criminal Code is analyzed. This note states that the need to adopt the draft law is due to the situation in Crimea and other regions of Ukraine in connection with the spread of facts of encroachment on the territorial integrity and inviolability of Ukraine. At the same time, it does not contain even an approximate (open) list of socially dangerous acts, in order to combat which the corresponding norm was included in the Criminal Code. That is, there is no such list in either the disposition of the considered article of the Criminal Code, or in the explanatory note to the draft law, on the basis of which it was included there. Therefore, it is stated that it does not seem possible to determine the legislative idea regarding the range of socially dangerous acts that should be covered by the concept of «obstruction» in Article 1141 of the Criminal Code. This situation most likely arose due to the fact that the relevant law not only introduced a new Article 1141 to the Criminal Code, but also increased sanctions in the existing Articles 110, 111, 113, 114 of the Criminal Code (which provide for liability for committing crimes against the foundations of national security of Ukraine), as well as Article 279 of the Criminal Code. Therefore, it seems that the main purpose of the relevant law was to strengthen criminal liability for socially dangerous acts, which at that time were already included in the Criminal Code, and not to criminalize a new act. It is noted that in order to clarify the social conditionality of the criminal law prohibition of obstructing the lawful activities of the Armed Forces of Ukraine and other military formations, the analysis of the following circumstances is of primary importance: 1) the social danger of the act (the social utility of the norm that provides for liability for committing this act), 2) systemic and legal consistency, 3) the completeness and non-excessiveness of the prohibition. It is concluded that the establishment and further preservation of criminal liability for obstructing the lawful activities of the Armed Forces of Ukraine and other military formations is socially conditioned. At the same time, the normprescription contained in Art. 1141 of the Criminal Code is no longer socially conditioned due to the violation of such a circumstance as the completeness and non-excessiveness of the prohibition.
