Родовий об’єкт домагання дитини для сексуальних цілей (ст. 156-1 КК України)

Abstract

У статті крізь призму суспільних відносин розглядається питання родового об’єкта кримінального правопорушення, відповідальність за яке передбачена ст. 156-1 КК України («Домагання дитини для сексуальних цілей»). Визначено, що домінуючий у сучасній науковій думці підхід, за яким родовий об’єкт розділу ІV Особливої частини КК (до структури якого і входить аналізоване правопорушення) розглядається двокомпонентно (як суспільні відносини щодо забезпечення статевої свободи та статевої недоторканості), має бути переглянутий. Аргументовано, що така позиція продиктована передусім застарілістю термінології із складником «статевий» і необхідністю її заміни на таку, що має у своєму складі слово «сексуальний». Окрім того, визначено, що для більшої чіткості родовий об’єкт має бути об’єднаний єдиною, уніфікованою категорією. На підставі аналізу наявних точок зору з цього приводу такою запропоновано розуміти «безпеку сексуальних стосунків між людьми». З огляду на це висловлено пропозицію внести зміни до чинної редакції назви розділу ІV Особливої частини КК.

The article considers the issue of the generic object of a criminal offense through the prism of social relations, the liability for which is provided for by Article 156-1 of the Criminal Code of Ukraine («Solicitation of a child for sexual purposes»). It is determined that the dominant approach in modern scientific thought, according to which the generic object of Section IV of the Special Part of the Criminal Code (the structure of which includes the analyzed offense) is considered in two components (as social relations regarding the provision of sex freedom and sex integrity), should be revised. It is argued that such a position is dictated primarily by the obsolescence of terminology with the component «sex» and the need to replace it with one that includes the word «sexual». In addition, it is determined that for greater clarity the generic object should be united by a single, unified category. Based on the analysis of existing points of view on this issue, it is proposed to understand «the safety of sexual relations between people» as such. In view of this, a proposal is made to amend the current wording of the title of Section IV of the Special Part of the Criminal Code.
