Науково-технічний прогрес і правопорушення у сфері безпеки дорожнього руху та експлуатації транспорту: окремі ракурси проблеми

Abstract

Статтю присвячено аналізу впливу науково-технічного прогресу в цілому та в транспортній сфері, зокрема, на стан так званої транспортнозалежної злочинності. При цьому стверджується, що йдеться не лише про правопорушення, які вчиняються учасниками дорожнього руху та експлуатації транспорту, а й про ті, що пов’язані з автономним доступом до транспортних засобів та управлінням ними. Проте всі ці правопорушення опосередковуються збитковою правосвідомістю людини, яка може бути як безпосереднім учасником дорожнього руху та експлуатації транспорту, так й особою, котра використовує автономний доступ до транспорту та його можливості для вчинення будь-яких правопорушень, зокрема, насильницьких і терористичної спрямованості, не будучи таким учасником. У статті на конкретних прикладах демонструється зв’язок між досягненнями науково-технічного прогресу в автотранспортній сфері та збільшенням можливостей, що дає цей прогрес злочинцям, діяння яких пов’язані із транспортною системою. Такий зв’язок впливає на динаміку ризиків для безпеки громадян та їх майна, а так само висвітлює досягнення науково-технічного прогресу у дещо несподіваному ракурсі. Робиться висновок, що дві останні науково-технічні революції вплинули на розвиток автотранспортної сфери, визначивши і її сьогоднішній стан, і проблеми, що пов’язані із дотриманням стану законності під час експлуатації транспортних засобів. Авторські твердження щодо проявів науково-технічного прогресу в автотранспортній сфері підкріплюються громадською думкою, що дозволяє дійти висновку про основні його «маркери». До таких належать: комфортні умови переміщення, швидкість переміщення та безпека експлуатації транспортних засобів.

The article is devoted to the analysis of the impact of scientific and technological progress in general and in the transport sector, in particular, on the state of the so-called transport-dependent crime. At the same time, it is claimed that it is not only about offenses committed by road users and transport operators, but also about those related to autonomous access to and control of vehicles. However, all these offenses are mediated by the harmful legal awareness of a person, who can be both a direct participant in road traffic and the operation of transport, and a person who uses autonomous access to transport and its opportunities to commit any offences, in particular, violent and terrorist-oriented, without being such a participant. The article demonstrates with specific examples the connection between the achievements of scientific and technical progress in the field of motor transport and the increase in opportunities that this progress gives to criminals whose actions are connected with the transport system. Such a connection affects the dynamics of risks for the safety of citizens and their property, and also illuminates the achievement of scientific and technical progress in a somewhat unexpected perspective. It is concluded that the last two scientific and technical revolutions influenced the development of the motor transport sector, determining both its current state and the problems associated with compliance with the state of legality during the operation of vehicles. The author’s statements regarding the manifestations of scientific and technical progress in the motor vehicle sector are supported by public opinion, which allows us to draw a conclusion about its main «markers». These include: comfortable conditions of movement, speed of movement and safe operation of vehicles.
