Кримінальна ситуація в Україні в умовах війни: основні тенденції та фактори, що їх зумовлюють

Abstract

У статті на основі аналізу даних державної статистичної звітності щодо кримінальних правопорушень в Україні за 2022–2024 рр., дослідницьких та аналітичних матеріалів щодо криміногенної ситуації у країні визначено основні тенденції динаміки кримінальних правопорушень в Україні під час війни, обʼєктивні та субʼєктивні фактори, які зумовили виникнення цих тенденцій, і характер їх впливу на кримінальну ситуацію в країні. Встановлено, що збройне вторгнення рф на територію Україні та похідні від нього процеси здійснили домінуючий вплив на стан, структуру та динаміку кримінальних правопорушень в Україні. Цей вплив реалізовувався через проміжний субʼєктивний фактор прийняття політико-правового рішення щодо максимального використання заходів кримінально-правої реакції на воєнно-політичну ситуацію в країні шляхом виявлення та документування кримінальних правопорушень проти основ національної безпеки України, воєнних та військових кримінальних правопорушень, умисних вбивств, учинених у результаті ворожих обстрілів, діянь, повʼязаних з ухиленням від мобілізації.The article, based on the analysis of data from the state statistical reporting on criminal offenses in Ukraine for 2022– 2024, research and analytical materials on the criminogenic situation in the country, identifies the main trends in the dynamics of criminal offenses in Ukraine during the war, the objective and subjective factors that determined the emergence of these trends, and the nature of their impact on the criminal situation in the country. It is established that the large-scale armed invasion of the russian federation into the territory of Ukraine and the processes arising from it had a dominant impact on the state, structure and dynamics of criminal offenses in Ukraine. This influence was exercised through the intermediate subjective factor of adoptinga political and legal decision on the maximum use of criminal lawmeasures in response to the military and political situation in the country by identifying and documenting criminal offenses against the foundations of national security of Ukraine, military criminal offenses and war crimes, intentional murders committed as a result of enemy shelling, acts related to evasion of mobilization.
