Проблеми призначення покарання у виді позбавлення державної нагороди України

Abstract

Стаття присвячена вивченню проблемних питань призначення нового для українського кримінального законодавства покарання у виді позбавлення державної нагороди України. Зокрема, виділено, проаналізовано та запропоновано розвʼязання семи таких проблемних питань. По-перше, окреслено коло тих державних нагород, яких особа може бути позбавлена при застосуванні цього виду покарання, і на протиставлення цьому – названі нагороди, яких не може стосуватися цей вид покарання. По-друге, уточнене визначене в КК коло кримінальних правопорушень, які становлять передумову призначення позбавлення нагороди. По-третє, визначене коло осіб, яким може бути призначений цей вид покарання, і коло осіб, до яких він не може бути застосований. По-четверте, поглибленому аналізу піддана і визначена підстава призначення цього виду покарання. По-пʼяте, вирішене питання про кількість державних нагород, яких особа може бути позбавлена при однократному застосуванні цього виду покарання. По-шосте, показано особливості застосування щодо позбавлення нагороди встановлених КК спеціальних правил призначення покарання. Нарешті, по-сьоме, доведено, що попри невизначеність строку, на який призначається судом цей вид покарання, його не можна вважати безстроковим і показано правові наслідки цього. При вирішенні кожного з проблемних питань призначення позбавлення нагороди сформульовані судження, окремі з яких можуть бути враховані законодавцем при подальшому розвитку кримінального законодавства України, а інші – можуть бути взяті до уваги судами при їх застосуванні.The article is devoted to the study of problematic issues of imposing a new punishment for Ukrainian criminal legislation in the form of deprivation of a state award of Ukraine. In particular, the solution of seven such problematic issues is highlighted, analyzed and proposed. Firstly, the range of state awards from which a person may be deprived when applying this type of punishment is outlined, and in contrast to this, the awards to which this type of punishment cannot apply are named. Secondly, the range of criminal offenses defined in the Criminal Code, which constitute a prerequisite for imposing deprivation of an award, is clarified. Thirdly, the range of persons to whom this type of punishment can be imposed, and the range of persons to whom it cannot be applied, is determined. Fourthly, the basis for imposing this type of punishment is subjected to an in-depth analysis and determined. Fifthly, the issue of the number of state awards from which a person may be deprived when applying this type of punishment once is resolved. Sixth, the features of the application of the special rules for imposing punishment established by the Criminal Code in relation to the deprivation of an award are shown. Finally, seventh, it is proven that despite the uncertainty of the term for which this type of punishment is imposed by the court, it cannot be considered indefinite and the legal consequences of this are shown. When resolving each of the problematic issues of imposing deprivation of an award, judgments are formulated, some of which may be taken into account by the legislator in the further development of the criminal legislation of Ukraine, and others may be taken into account by the courts when applying them.
