This article examines the evolution of the ideology underpinning the criminal law protection of Ukraine’s national security. The topic is relevant because criminal law is a vital instrument for safeguarding Ukraine’s national interests. Analysis of the historical development of relevant provisions reveals changes in legislative approaches to defining the most dangerous threats to statehood and their connection with political, ideological, and constitutional transformations. This article aims to analyse the ideology behind criminal law protecting Ukraine’s national security and identify trends and problems in regulatory control across historical stages. To this end, Soviet criminal legislation and the 2001 CC of Ukraine have been examined. It has been established that the evolution of this ideology reflects a change in how such protection is perceived and prioritised. During the Soviet era, the relevant provisions were primarily aimed at safeguarding the political regime, the socialist system, and the party’s monopoly on power. This gave them an ideologicalrepressive nature. Following Ukraine’s restoration of independence and the adoption of the 1996 Constitution and the 2001 CC, the values of criminal law protection were re-evaluated to include sovereignty, territorial integrity, the democratic constitutional order, and other national interests in relation to human rights and freedoms. The events of 2014 and 2022 marked a new stage in the development of criminal legislation in this area. This stage is characterised by the criminalisation and differentiation of new anti-social activities and tougher penalties for existing offences. In summary, criminal law protection of Ukraine’s national security is shaped by military and political challenges and requires improvements to ensure systematicity, legal certainty, and consistency with the constitutional values of a democratic rule-of-law state.
