«Дотримання прав людини при виконанні покарань і поводженні із засудженими в Україні» – комплементарність процесу і результатів дослідження фундаментальної теми

Abstract

У статті автори презентували процес і результати дослідження фундаментальної теми «Дотримання прав людини при виконанні покарань і поводженні із засудженими в Україні» через методологію комплементарності. Цей підхід зумовлено хронологією і змістом результатів наукової діяльності фахівців відділу дослідження проблем кримінально-виконавчого права. У статті наголошено на тому, що комплементарність дозволила вибудувати відкриті зв’язки науковців із фахівцями з різних галузей знань, з практиками ДКВС України, моніторами національного превентивного механізму. У статті відмічено, що у 2022 р. акцент робився на законопроєктній роботі. Об’єктивна потреба розширення наукового і науково-практичного дискурсу дотримання прав людини в установах виконання покарань, в інших місцях несвободи у 2023 р. в умовах провадженого воєнного стану спрямувала наукову роботу на партнерство з фахівцями-практиками для проведення емпіричного етапу дослідження, забезпечення якості отриманих наукових результатів. У 2024 р. передбачалися систематизація наукових результатів, науковий супровід законотворчих ініціатив, наукове забезпечення освітнього процесу і підвищення кваліфікації моніторів національного превентивного механізму, що має значення для вирішення концептуальних завдань реформування вищої юридичної освіти, доктринальних вимог євроінтеграційних процесів у науковій сфері, прогресуванням пробації.In the article, the authors present the process and results of the research of the fundamental topic «Observance of human rights in the execution of sentences and treatment of prisoners in Ukraine» through the methodology of complementarity. This approach is based on the chronology and content of the results of the scientific activities of the specialists of the Department for Research of Criminal Executive Law. The article emphasizes that the complementarity approach allowed building open ties between scientists and specialists from various fields of knowledge, with practitioners of the State Criminal Enforcement Service of Ukraine, and monitors of the National Preventive Mechanism. The article notes that in 2022, the focus will be on the legislative work. The objective need to expand the scientific and scientificpractical discourse on human rights in penitentiary institutions and other places of detention in 2023, under martial law, directed the scientific work to partnership with practitioners to conduct the empirical stage of the study and ensure the quality of the scientific results obtained. The year 2024 envisaged systematization of scientific results, scientific support of legislative initiatives, scientific support of the educational process and advanced training of monitors of the National Preventive Mechanism, which is important for solving the conceptual problems of reforming higher legal education, doctrinal requirements of European integration processes in the scientific field, and the progress of probation.
