This article examines current issues relating to the protection of Ukraine’s territorial integrity and inviolability under criminal law, against the backdrop of the growing role of the information sphere in addressing geopolitical challenges. Particular emphasis is placed on the dangers posed by situations where destructive information campaigns are carried out by foreign entities or public figures capable of shaping international public opinion. The aim of the article is to ascertain the possibility of a criminal law assessment of public denial of Ukraine’s existence in the context of the provisions of Article 110 of the Criminal Code of Ukraine, to identify theoretical and practical problems in its application, and to substantiate the author’s proposals for further improvement of the current legislation in this area. This paper analyses the provisions of Article 110 of the Criminal Code of Ukraine through the prism of the principles governing the territorial and personal scope of criminal law, and demonstrates that the current version of the article contains certain gaps regarding the prosecution of foreign entities which, whilst not being representatives of foreign states, carry out subversive information activities against Ukraine outside its borders. Particular attention is paid to the study of judicial practice, which indicates that Parts 2 and 3 of Article 110 of the Criminal Code of Ukraine may be applied to foreign officials only where qualifying characteristics are present, in particular the status of a representative of authority. The article also provides a brief overview of the development of criminal legislation regarding the protection of state sovereignty and freedom of expression from the Soviet period to the present day, which has shown that, historically, such criminal law prohibitions were often used as an instrument of political and ideological influence, thereby posing risks of restricting freedom of speech. At the same time, the article analyses the fundamental international legal standards in the field of ensuring freedom of expression, which establish the criteria for the admissibility of restrictions on such rights, and justifies the necessity of adhering to the principles of legal certainty, proportionality and necessity even under martial law. The study presents the author’s proposed revision of the wording of Part 2 of Article 110 of the Criminal Code of Ukraine, which justifies the need to expand the scope of specific offenders to include public figures and public personalities.
