This academic article examines the issue of defining the role of the legal profession within the military justice system. The relevance of this topic stems from the need to develop the military justice system in Ukraine under martial law. The aim of this academic article is to define the conceptual foundations of the place and role of the legal profession within Ukraine’s military justice system, as well as the feasibility and advisability of establishing a ’military legal profession’ in Ukraine. It is argued that the legal profession is an integral component of any justice system, including military justice as a subsystem of criminal justice. At the same time, its affiliation with military justice is purely functional and lacks the necessary characteristics of an ’organisational’ component of such a system. The problems associated with the creation of a ’military legal profession’ are highlighted, namely: 1) its organisational separation would result in the loss of the essential characteristics of the legal profession as such; 2) ’military lawyers’ would lose a number of guarantees regarding their practice and would be restricted to a narrow category of cases; 3) the creation of a ’military legal profession’ would not provide the military justice system with any significant advantages, but would instead exacerbate the risks of ’institutional insularity’. It has been demonstrated that the concept of a ’military lawyer’ can only be considered in the context of specialisation within the legal profession; however, it creates risks of breaching the requirements governing the advertising of legal services and jeopardises the principles of the independence of the legal profession, respect for the legal profession, competence and integrity, and so on. Promising alternative approaches to ensuring the rule of law in the military sphere and providing legal assistance to its subjects, rather than establishing a ’military bar’, have been identified, namely: the practical provision of guarantees for legal practice in the military sphere; the involvement of lawyers in defending the rights of military personnel within the framework of the free secondary legal aid system; and the development of the legal service of the Ministry of Defence of Ukraine.
