Реалізація принципу гуманізму в кримінально-виконавчій діяльності

Abstract

У науковій статті досліджуються питання реалізації принципу гуманізму в кримінально-виконавчій діяльності. Окрема увага насамперед приділяється принципу гуманізму як однієї з основних конституційних засад кримінально-виконавчої політики та кримінально-виконавчого права. Стверджується, що гуманізація кримінально-виконавчої політики повинна реалізовуватися як на рівні її формування, відображаючись у нормах кримінально-виконавчого законодавства з урахуванням норм міжнародного права, так і на рівні її реалізації. Гуманізація кримінально-виконавчої політики України на рівні її реалізації може відбиватися: в умовах відбування покарань, засобах виправлення та ресоціалізації засуджених – режимі, соціально-виховній роботі тощо. Відтак, забезпечення належних умов тримання засуджених, що становить сутнісну ознаку реалізації принципу гуманізму в концепції кримінально-виконавчої діяльності, розглядається як прояв гуманного ставлення до них. Констатується факт неналежних, а часом незадовільних умов тримання засуджених в установах виконання покарань, що не відповідають міжнародним стандартам, є за своєю суттю нелюдськими та такими, що принижує гідність, поводженням, про що неодноразово визнавав Європейський суд з прав людини. З огляду на наявність окреслених проблем зроблено висновок про необхідність вжиття заходів щодо приведення умов відбування покарань до міжнародних, у тому числі європейських стандартів, не лише на рівні закріплення відповідних норм у законодавстві, а й на практиці виконання-відбування покарань.

The scientific article examines the issues of implementing the principle of humanism in criminal-executive activities. Particular attention is paid primarily to the principle of humanism as one of the main constitutional principles of criminalexecutive policy and criminal-executive law. It is argued that the humanization of criminal-executive policy should be implemented both at the level of its formation and reflected in the norms of penal legislation taking into account the norms of international law, and at the level of its implementation. The humanization of criminal-executive policy of Ukraine at the level of its implementation can be reflected: in the conditions of serving sentences, means of correction and resocialization of convicts – regime, social and educational work, etc. Therefore, ensuring proper conditions for the detention of convicts, which is an essential feature of the implementation of the principle of humanism in the concept of criminal-executive activities, is considered as a manifestation of a humane attitude towards them. The fact of adequate, and sometimes unsatisfactory, conditions of detention of convicts in penal institutions that do not meet international standards is stated, which are inherently inhuman and degrading treatment, which has been repeatedly recognized by the European Court of Human Rights. Given the existence of the outlined problems, a conclusion is made about the need to take measures to bring the conditions of serving sentences into line with international, including European standards, not only at the level of enshrining relevant norms in legislation, but also in the practice of executing and serving sentences.
