До проблеми розуміння понять «зайняття посади» та «обрання на посаду» при кваліфікації посадового колабораціонізму

Abstract

У статті проведено дослідження понять «зайняття посади» та «обрання на посаду» як суспільно небезпечних діянь посадового колабораціонізму (частини 2, 5, 7 ст. 111-1 Кримінального кодексу України) крізь призму хронологічного аспекту та аспектів їх обсягу й змісту. 1. Щодо хронологічного аспекту установлено, що особа вважається такою, що зайняла посаду або обрана на посаду, із моменту винесення акта про призначення або обрання її на відповідну посаду. Із цього моменту посадовий колабораціонізм (за частинами 2, 5 або 7 ст. 111-1 КК України) слід вважати закінченим кримінальним правопорушенням. 2. Стосовно аспекту обсягу понять «зайняття посади» та «обрання на посаду», виявлено, що ці поняття мають охоплювати як факт працевлаштування, так і виконання подальших функцій на посаді. У зв’язку з цим кваліфікація самої трудової діяльності особи на посаді має здійснюватися лише за нормами ст. 111-1 КК України та додаткової кваліфікації за сукупністю кримінальних правопорушень зі ст. 111 КК України (державна зрада) не потребує. 3. Щодо аспекту змісту розглядуваних понять, визначено, що реальні функції особи, яка зайняла посаду в незаконних органах, мають ураховуватися: а) при кваліфікації за ч. 5 ст. 111-1 КК України, якщо особа зайняла посаду, яка за своєю назвою вказує на наявність організаційно-розпорядчих або адміністративно-господарських функцій, але фактично таких функцій не виконувала і не могла виконувати; б) при кваліфікації за ч. 7 ст. 111-1 КК України, якщо особа обіймала такі посади в незаконних судових або правоохоронних органах, які не передбачали виконання владних, організаційно-розпорядчих або адміністративно-господарських функцій. В обох зазначених випадках дії особи мають кваліфікуватися за ч. 2 ст. 111-1 КК.

The article studies the concepts of «occupation of a position» and «election to a position» as socially dangerous acts of collaborationism of officials (parts 2, 5, 7 of Article 111-1 of the Criminal Code of Ukraine) through the prism of the chronological aspect and aspects of their scope and content. 1. Regarding the chronological aspect, it is established: a person is considered to have occupied a position or been elected to a position from the moment of issuing an act on appointment or election to the relevant position this person. From this moment on, collaborationism of officials (under Part 2, 5 or Article 111-1 of the Criminal Code of Ukraine) should be considered a completed criminal offense. 2. Regarding the aspect of the scope of the concepts of «occupation of a position» and «election to a position», it was found that these concepts should cover both the fact of employment and the performance of further functions in the position. In this regard, the qualification of the person’s work activity in the position should be carried out only according to the norms of Art. 111-1 of the Criminal Code of Ukraine and additional qualification under Art. 111 of the Criminal Code of Ukraine (high treason) is not required. 3. Regarding the aspect of the content of the concepts under consideration, it is determined that the real functions of a person who has taken a position in illegal bodies should be taken into account: a) when qualifying under Part 5 of Art. 111-1 of the Criminal Code of Ukraine, if the person took a position that by its name indicates the presence of organizational and managerial or administrative and economic functions, but in fact did not perform and could not perform such functions; b) when qualifying under Part 7 of Art. 111-1 of the Criminal Code of Ukraine, if the person held such positions in illegal judicial or law enforcement bodies that did not involve the performance of power, organizational and managerial or administrative and economic functions. In both of these cases, the actions of the person should be qualified under Part 2 of Article 111-1 of the Criminal Code of Ukraine.
