Щодо соціально-правових і кримінологічних особливостей дезертирства, що вчиняється в умовах воєнного стану

Abstract

Статтю присвячено встановленню й всебічному аналізу впливу умов воєнного стану, запровадженого в Україні, на явище дезертирства. Такий вплив розглядається через встановлення й розкриття змісту низки соціальноправових та кримінологічних особливостей, якими характеризується дезертирство після початку повномасштабного вторгнення рф в Україну. У цілому підтверджується гіпотеза про те, що явище дезертирства як протиправне суспільно небезпечне діяння в умовах воєнного стану отримало нового гострого соціального значення. І свідченням цього якраз й є низка встановлених соціально-правових та кримінологічних особливостей дезертирства. При цьому до головних соціально-правових особливостей дезертирства в умовах запровадження у країні режиму воєнного стану автором віднесено: а) зважене ставлення законодавця до цього протиправного діяння, що відбиває неоднозначну позицію соціуму до оцінки останнім дезертирства; б) набуття дезертирством у контексті воєнного стану нового соціального значення як такого; в) неоднозначне ставлення української громади до оцінки цього протиправного діяння. Головними кримінологічними особливостями дезертирства визначено: а) значний злочинний потенціал, що проявився з початком повномасштабного вторгнення рф в Україну; б) залежність кількості випадків дезертирства від конкретної ділянки фронту; в) середній рівень латентності дезертирства, на який впливають різновекторні чинники; г) відсутність домінантного мотиву або принаймні кількох домінантних мотивів під час вчинення цього правопорушення; д) вплив фактору війни на характер явища дезертирства у цілому. Виокремлені особливості важливо враховувати при аналізі цього явища та під час опрацювання системи заходів запобігання.

The article is devoted to the establishment and comprehensive analysis of the impact of the conditions of martial law introduced in Ukraine on the phenomenon of desertion. This influence is considered through the establishment and disclosure of the content of a number of socio-legal and criminological features that characterized desertion after the beginning of the full-scale invasion of the Russian Federation into Ukraine.In general, the hypothesis that the phenomenon of desertion as an illegal socially dangerous act in the conditions of martial law has acquired a new acute social significance is confirmed. And a number of established socio-legal and criminological features of desertion are proof of this. At the same time, the main socio-legal features of desertion in the conditions of the introduction of martial law in the country are attributed by the author: a) the balanced attitude of the legislator to this illegal act, which reflects the ambiguous position of society towards the latter’s assessment of desertion; b) acquisition of desertion in the context of martial law as a new social meaning; c) ambiguous attitude of the Ukrainian community to the assessment of this illegal act. The main criminological features of desertion are defined as: a) significant criminal potential that appeared with the beginning of the full-scale invasion of the Russian Federation into Ukraine; b) dependence of the number of cases of desertion on a specific section of the front; c) the average level of desertion latency, which is influenced by various vector factors; d) the absence of a dominant motive or at least several dominant motives during the commission of this offense; e) the influence of the war factor on the nature of the phenomenon of desertion as a whole. It is important to consider the specific features when analyzing this phenomenon and when developing a system of prevention measures.
